Terms and conditions of the Referrals promotion May-June 2024 for Providers Worldwide

1. General conditions

1.1. The Promotion "Referrals May-June 2024 for Providers" (hereinafter referred to as the "Promotion") is organised by the company Mailjour Systems OÜ. (hereinafter referred to as "Mailjour" or the "Organiser"), domiciled in Tallinn, Republic of Estonia, and is aimed at encouraging the registration of new Commerce and Client users on the Mailjour Platform (hereinafter referred to as the "Platform") during the period of the Promotion.
1.2. The Promotion shall run from 10 May 2024 at 00:00 hours until 10 June 2024 at 23:59 hours (hereinafter referred to as the "Term").
1.3. The Promotion is valid for all Providers participating in the Referral Program (hereinafter referred to as the "Referrer") who refer new Commerce and Client users (hereinafter referred to as the "Referred", "Referral") to the Platform during the Term and comply with the requirements set out in the Referrals Programme General Terms and Conditions and the Terms and Conditions of this Promotion as described in this document (hereinafter, the "Referrer").
1.4. Mailjour reserves the right to verify the identity of the Referrers and to request any additional documentation and/or data in order to corroborate the details of the Referrers and/or the data entered in the registration. 1.5. Mailjour reserves the right to disqualify those Referrers who do not comply with the requirements set out in these Terms and Conditions.

2. Rewards

2.1. The Referrer will receive one (1) Amazon Gift Card worth 200€ (two hundred euros) on each of the first 5 (five) Commerce Referrals made through the Platform, within the Promotion Term and provided that the following conditions are met:

  • The Referred must be of Commerce type.
  • The Referred must complete the registration process on the Platform, including all validation steps, within 10 (ten) calendar days from the date of registration on the Platform through the Referrer's referral link.
  • The Referred must complete at least one service agreement with the Referrer within 30 (thirty) calendar days from the date of registration on the Platform through the Referrer's referral link.
  • The Referred must not have been referred by another Referrer before registering on the Platform through the Referrer's referral link.
  • The Referred must not have registered on the Platform before registering through the Referrer's referral link.
  • The Referred must provide the documentation requested by Mailjour to complete the validation of the business.

2.2. The Referrer will receive a compensation of 10 cents per service agreed and successfully paid by the Referred to other providers than the Referrer, within the Promotion Term and provided that the following conditions are met:

  • The Referred can be of Commerce or Client type.
  • The Service must be completed and paid by the Referred within 2 (two) calendar days from the date of completion of the service.
  • The Referred has less than 1 year registered on the platform and has registered before the end of the term of this promotion.

2.3. Rewards are not transferable.
2.4. In case of compensation for each successful transaction according to section 2.2., the Referrer shall issue a valid tax invoice to Mailjour Systems OÜ when it wants to claim compensation, including the taxes applicable to its country of residence.
2.5. Rewards cannot be accumulated with other promotions in force on the Platform.
2.6. Rewards cannot be used for illicit or criminal purposes.
2.7. Rewards may not be used for the purchase of products restricted by law.

3. Delivery of rewards

3.1. Gift Cards will be delivered to the Referrers who refer Commerce users to the Platform during the Term and comply with the requirements set out in these Terms and Conditions, within 60 (sixty) calendar days after the registration of the Referred on the Platform. The communication will be made to the email address provided in the registration.
3.2. The compensation for each successful transaction according to section 2.2. will be paid to the Referrer within 10 (ten) calendar days after the payment request is made by the Referrer. The payment will be made through bank transfer to the account provided by the Referrer or through an Amazon Gift Card worth the amount of the compensation. If the compensation is made through bank transfer, the Referrer shall issue a valid tax invoice to Mailjour Systems OÜ, including the taxes applicable to its country of residence.

4. Disclaimer of liability

4.1. Mailjour shall not be liable for any loss or damage of any kind whatsoever suffered by Merchants, their personal data and/or property, arising out of or in connection with their participation in the Promotion, the delivery of the Rewards and/or the use of the Rewards.
4.2. Mailjour shall not be responsible for the use made of the rewards by the Referrers or the Referrals.
4.3. Mailjour shall not be liable for any problems in the delivery of the rewards resulting from the lack of truthfulness or accuracy of the data provided by the Referrers at registration or during communications with Mailjour.

5. Acceptance of the Terms and Conditions

5.1. Participation in the Promotion implies knowledge and acceptance of these Terms and Conditions, the Terms and Conditions of the Referrals Programme and the General Terms and Conditions of the Platform.

6. Applicable law and jurisdiction

6.1. These Terms and Conditions and the Promotion shall be governed by, construed and enforced in accordance with the laws of the Republic of Estonia.
6.2. If the dispute arising out of these Terms and Conditions cannot be settled by negotiation, the dispute shall be settled in the Harju County Court.
